DMCA & Copyright Policy

How we handle copyright infringement claims and protect intellectual property.

TIAS ("The Internet Antique Shop") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.

This policy outlines how to submit a copyright infringement notice, what to do if your content was removed in error, and our procedures for handling repeat infringers.

1. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible on TIAS in a way that constitutes copyright infringement, please notify our DMCA agent with a written notice containing the information outlined below.

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material that it has been removed
  • Provide the user with information about submitting a counter-notification if they believe the removal was in error

2. DMCA Notice Requirements

To be effective, your DMCA notice must be in writing and include the following information:

  • Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
  • Identification of the infringing material: A description of where the allegedly infringing material is located on TIAS, with enough detail for us to find it (such as the URL of the listing or page).
  • Your contact information: Your name, mailing address, telephone number, and email address.
  • Statement of good faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • Statement of accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  • Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability.

3. Counter-Notification Process

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include:

  • Identification of the material: A description of the material that was removed and its location before removal (including the URL).
  • Statement under penalty of perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your contact information: Your name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which TIAS may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, TIAS has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our services or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is repeat infringement.

Factors we consider when determining whether to terminate an account include:

  • The number of valid infringement notices received
  • Whether counter-notifications were submitted and their outcome
  • The nature and severity of the infringement
  • Whether the user appears to be acting in good faith

5. Good Faith & Misrepresentation

Please be aware that there can be penalties for false claims under the DMCA. Before submitting a DMCA notice, please ensure that you actually own the copyright to the material in question or are authorized to act on behalf of the copyright owner.

Consider whether the use of the material might constitute fair use before filing a notice. Fair use is a legal doctrine that permits limited use of copyrighted material without requiring permission from the rights holder. If you are unsure whether the content you want to report infringes your copyright, you may wish to seek legal advice.

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake, may be liable for damages, including costs and attorneys' fees.
